The crime of Driving Under the Influence (DUI) can be defined as driving or being in actual physical control of a car while under the influence of drugs or alcohol. It is illegal in California to drive with a blood alcohol concentration (“BAC”) of 0.08% or greater for drivers 21 years of age or older operating a regular passenger vehicle, 0.04% or greater for drivers operating a commercial vehicle, and 0.01% or greater for drivers younger than 21 years of age.
