Driving Under the Influence (DUI) is a crime in which a person is driving or has physical control of a vehicle while under the influence of drugs or alcohol. Drunk driving is a common name for this offense. Many individuals are unaware it is illegal in California to drive with a blood alcohol concentration (“BAC”) of 0.08% or greater for drivers 21 years of age or older operating a regular passenger vehicle, 0.04% or greater for drivers operating a commercial vehicle, and 0.01% or greater for drivers younger than 21 years of age.
An individual can also be arrested for driving with any detectable amount of an illicit or even a prescription drug in their system.
The penalties for drunk driving or driving impaired in Ventura County are very serious and range from jail time, fines, fees, DUI classes, court-ordered alcohol counseling, probation, license suspensions, and more. If a person is arrested under suspicion of a DUI and refuses to take the chemical test (blood or breath), the person could be punished for this refusal. A refusal to submit to the test could result in a one-year suspension of their driver’s license.
